No Is the best AnswerDr. Katz is uneasy with the PI's response.  He should probably stop the procedure as it is clearly not in the approved protocol

It is understandable how Dr. Katz might be conflicted.  However in this circumstance, Dr. Katz  should not be a mouse. He should demand that the project be stopped immediately and the animal euthanized. The study was being conducted in an unethical way because the new procedure had not been approved by the IACUC.  

It would be unethical for data derived from this study to be published unless the author disclosed that the data was collected surreptitiously without an approved protocol. It seems unlikely that any journal editor would accept such data.
